Terms of Service

1. Acceptance of Terms
By accessing or using Orbit (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Orbit is a social platform that allows users to share real-time moments with small, private groups of people they know. All posts are captured live within the app. The Service is provided free of charge and requires a valid phone number for account creation and verification.
3. Account Registration
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.
You may not use another person's account without permission. Accounts registered by automated means are prohibited.
4. SMS Messaging and Two-Factor Authentication
By creating an account and agreeing to these Terms, you consent to receive SMS text messages from Orbit at the phone number you provide during registration. These messages are used solely for account security purposes, including:
- Verification codes during account creation
- Two-factor authentication (2FA) when signing in
- Verification codes when changing your phone number or recovering your account
Message and data rates may apply depending on your mobile carrier and plan. The frequency of messages depends on your account activity and security events; you will only receive a message when you initiate an action that requires verification.
These messages are transactional and security-related. They are not promotional. Because they are necessary to protect your account, they cannot be opted out of while your account remains active. If you no longer wish to receive SMS messages from Orbit, you may delete your account under Settings → Account → Delete Account.
For help, reply HELP to any Orbit SMS message or contact us at support@orbit.org. Orbit is not responsible for delays or failures in SMS delivery caused by your mobile carrier or factors outside our control.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable local, state, national, or international law
- Transmit any material that is unlawful, harmful, or infringing
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the integrity or performance of the Service
- Harvest or collect user data without consent
- Harass, threaten, or abuse other users
- Post content that constitutes hate speech or explicit sexual material
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Orbit, Inc. and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.
You retain all rights to content you create and post within the Service. By using the Service, you grant Orbit a limited, non-exclusive license to store and display your content solely for the purpose of delivering the Service to you and your group members.
7. Termination
We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately. You may request an export of your data within 30 days following termination by contacting support@orbit.org.
8. Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis without any warranty of any kind. Orbit expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the fullest extent permitted by law, Orbit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or goodwill, arising out of or in connection with these Terms or the use of the Service, even if advised of the possibility of such damages.
10. Governing Law
These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Washington State.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice before material changes take effect by posting the new Terms on this page and, where appropriate, notifying you by SMS or in-app notification. Your continued use of the Service constitutes acceptance of the revised Terms.
